Terms of Sale

BASIC CONDITIONS

These terms and conditions are valid for all legal relations arising between customers and the seller, the owner of Miki24.ee e-shop, Miki OÜ.

In addition to these terms and conditions, the legal relations arising from the purchase of goods through the Miki24.ee e-shop are governed by the legislation of the Republic of Estonia.

Miki OÜ has the right to amend and supplement these terms and conditions, price lists and terms and conditions of special offers in order to develop the e-shop and to increase the reliability of use. Changes and amendments to the terms and conditions and the price list shall take effect upon publication on https://www.miki24.ee.

If an order is submitted before the new terms and conditions come into force, the terms and conditions in force at the time of submission of the order shall apply, unless otherwise provided by law or these requirements.


MERCHANDISE SELECTION

For quick and accurate product selection use the category menu on the left and the sorting menu on the right by brand, type, age, size and so on.  You can also select a product by brand by clicking on the corresponding logo.

Clicking on the product picture will take you to a page with detailed description, where you can see enlarged images, choose packaging or related products.


COMMODITY PRICE

Prices in miki24.ee e-shop are valid at the moment of payment.

All prices include 22% VAT for purchases within Estonia.

Delivery charges may be added to the prices according to the delivery method selected at checkout.


ADDING TO CART

Once you have selected an item, click on the "Add to Cart" button. The selected item will automatically go to your cart, and you can continue choosing the next item.

You can always edit, add or remove items from your cart by going to the "My Cart" section.


ORDER PLACEMENT

You can start the ordering process by clicking "My Cart" or by clicking the "Checkout" link at the top of the site.


CHOICE OF DELIVERY METHOD

You can purchase goods as a guest or as a registered user. If you are a registered user, the checkout process is faster, as the required fields are filled in automatically with the data you provided during registration. Please be careful when filling in the address data. Next, choose a suitable delivery method SmartPost, Omniva or self-delivery. In case the product cannot be delivered by the method you have chosen, please choose another method or contact us.


PAYMENT OF ORDER

The Customer may choose between the following payment methods:

  1. 1.Payment through a bank link
  2. 2. Credit card payment
  3. 2. Payment by bank transfer. The company's details are specified in the 'Contacts' section. When choosing this payment method, please send a copy of the payment order to info@miki24.ee."

     The goods shall be deemed purchased and the purchase agreement shall be deemed concluded from the moment the specified amount is received by Miki OÜ. After payment, you will receive the original invoice to the e-mail address specified when placing the order.


SHIPPING METHOD AND COST

1. SmartPost postal machine - 3.90 €

Postal machines that work 24 hours a day, 7 days a week. To receive your parcel, you will need to enter the code received in an SMS message from SmartPost on the touch screen of the machine. Delivery to Saaremaa is one day longer than to the mainland. Delivery to Hiiumaa is once every 3 days. Storage of the parcel in the dispenser up to 7 days.

2. Omniva postal machine - 3.80 €

Postal machines that work 24 hours a day, 7 days a week. To receive your parcel, you will need to enter the code received in an SMS message from Omniva on the touch screen of the machine.


When receiving goods from Omniva, SmartPost, we recommend that you immediately inspect the packaging and, if there is any external damage, immediately report the damage by e-mail to info@miki24.ee.


DELIVERY DATES

The goods in stock are delivered within 1-7 days within Estonia. In case the goods you have ordered are out of stock and have to be ordered from the supplier and therefore delivery by the specified date is impossible, as well as in other cases when timely delivery of the goods is not possible due to reasons beyond the control of Miki OÜ, we will inform you about the delay at the contact phone number or by e-mail specified in the order within 2 days from the date of entry into force of the purchase agreement, and we will specify a new delivery date for the ordered goods. When ordering several products, the delivery time depends on the delivery time of the product with the longest delivery time. In case you are no longer interested in the purchase due to the extension of the delivery period, you have the right to cancel the order, and the amount paid by you (including shipping costs) will be refunded to you. The seller is not responsible for any delay in delivery of goods if it is caused by inaccurate, incomplete or incorrect data provided by the customer when placing the order.


RETURNS

The customer has the right to withdraw from the purchase made within 14 days from the date of delivery of the order to the customer, notifying the seller in writing, indicating the reason for returning the goods. In case of withdrawal from the transaction, the customer is obliged to return the purchased goods to the seller within 14 days from the date of notification of the seller of his desire to withdraw from the transaction. All costs associated with the return of the goods, as well as the amount for the initial delivery paid by the online store, the client pays (except in cases of return of goods with defects). After receiving the goods back, the seller is obliged to return to the customer all the money paid for the goods, including the costs paid by the customer for the delivery of the goods from the store, to the same settlement account from which the payment for the goods was made, within 14 days. In order to exercise the right to return the goods and to withdraw from the transaction, the customer must carefully open the packaging of the goods and return the goods together with the packaging. The principle of reasonableness applies to the return of goods removed from the packaging. Goods whose packaging cannot be restored to the condition in which they were purchased shall not be returned. The returned goods must not have been used. Food, canned food, hygiene and care products, vacuum-packed goods are accepted back or exchanged only if the packaging is intact. Purchased goods are not subject to return if there is a note in the explanation that the goods are not returnable, if the goods are made according to personal requirements, or if the goods are delivered under the order or under the conditions of the customer.


TERMS OF CLAIM

Miki OÜ is liable for defects occurring within 2 years from the date of purchase, but not later than 2 months from the date of discovery of the defect. During the claim period, the buyer is entitled to free repair at the expense of the store. In case the repair of the goods is impossible, the goods will be replaced on the basis of a decision made by an authorized workshop. In case of returning the defective goods, you will be refunded the amount paid, together with the cost of transportation, to the specified bank account no later than 14 days from the date of return of the defective goods. The right to claim is valid provided that the goods have been used only under the conditions specified and only in the household. If the failure is due to the manufacturer's fault, all defects in production and materials, as well as the cost of labor and spare parts, shall be compensated. Breakdowns caused by external conditions (lightning, power surges, insufficient ventilation, leaky batteries, fire, flooding, natural wear and tear, etc.), as well as incorrect handling of the product and defects in consumables are not eligible for compensation. The right to claim is only valid upon presentation of the original document. Claims do not include training in the use of the goods, adjustment, maintenance, cleaning, restoration of their marketability, as well as elimination of defects caused by non-compliance with the rules of use. If the object of the claim is replaced by another object, the goods are subject to a new claim period for the same period. If one of the components is replaced, the new claim period applies to the replaced component.


Miki OÜ does not accept claims if:

1. When the product is presented to the store for repair, the purchase document required for repair is not provided or the data in the purchase document has been changed unauthorized.

2. The serial number or model number has been changed, deleted, moved or is illegible.

3. The design of the product or its factory configuration has been unauthorizedly changed.

4. the product has failed through the owner's fault as a result of improper use, failure to follow instructions for use, or neglect, care, or overuse.

5. Normal physical wear and tear has occurred in the normal course of use.


LIABILITY OF THE PARTIES AND FORCE MAJEURE

Miki OÜ shall be liable to you and you shall be liable to Miki OÜ for damages caused to the other party by breach of these terms and conditions in cases and to the extent provided by the laws of the Republic of Estonia. Miki OÜ shall not be liable for damage or delay in delivery of the goods incurred by you if the damage or delay in delivery is caused by circumstances which Miki OÜ could not influence and the occurrence of which Miki OÜ did not foresee and could not have foreseen (force majeure).

PRIVACY POLICY

PRIVACY POLICY

When registering in the store and making purchases, the merchant stores the personal data (first and last name, regular and e-mail addresses, contact phone number and Google Analytics data) and all information about the purchases made about the customer.

All data collected from the customer during the checkout process is considered by the seller as personal data of the customer and is treated as confidential information in accordance with the Personal Data Processing Act for better purchase planning and analysis of consumer habits.

The Seller does not transfer any of the received data to third parties, except for the minimum data necessary to organize the delivery of goods. The customer has the right to view the data in the possession of the seller and to prohibit further processing.

The use of encrypted data transmission channel between the store and banks ensures that no outsider, including the seller, has access to the personal bank details of the customer.

All disagreements between the customer and the seller are resolved through negotiations.

The seller responds to complaints and claims of the client by e-mail within 15 working days. If the disagreement cannot be settled by reaching a compromise, the customer has the right to turn to the Consumer Protection Board or Tallinn City Court to protect his/her interests. All disputes arising from lack of agreement or not regulated by these terms and conditions shall be settled on the basis of the legislation in force in the Republic of Estonia.


LIABILITY OF THE PARTIES AND FORCE MAJEURE

Miki OÜ shall be liable to you and you shall be liable to Miki OÜ for damages caused to the other party by breach of these terms and conditions in cases and to the extent provided for by the laws of the Republic of Estonia?

Miki OÜ shall not be liable for any damage or delay in delivery of the goods incurred by you if the damage or delay in delivery is caused by circumstances which Miki OÜ could not influence and the occurrence of which Miki OÜ did not foresee and could not have foreseen (force majeure).
